AddressPal Terms and Conditions

Important Notice
By ORDERING items for shipment by An Post AddressPal the Customer agrees to these terms and conditions. By the conditions set out below, An Post and its servants and agents are firstly not to be liable at all for certain losses and damage, and secondly, wherever they are to be liable, the amount of liability is strictly limited as stated in conditions 7 and 8.

1. Definitions

In these conditions the following expressions shall have the meaning hereby respectively assigned to them i.e. 
    (a) “AddressPal page” means the page on the An Post Website where the Customer signs up for the AddressPal service.
    (b) "AddressPal Service" means the services provided by An Post under the name AddressPal and such other services as An Post shall from time to time decide.
    (c) "Customer" shall mean the individual or company who has contracted An Post to deliver their on-line shopping using a UK proxy address provided by An Post.
    (d) “Collection Point” means an address (usually an An Post facility) in Ireland chosen by the Customer from a list provided by An Post.
    (e) "Item" shall mean any package, letter, parcel and the contents thereof.
    (f) “Oversize items” means Items which exceed the following dimensions: 72cm x 31cm x 25cm and weighing less than 20kgs.
    (g) An Post’s “standard size and weight dimensions for parcels” are: Length 1.5 meters, Length plus girth 3m, girth 2*(depth plus width).
    (h) "Perishable Goods" shall mean types of goods whose qualities may worsen or which tend to spoil easily under the influence of changes in climate, temperature, elevation or even general environmental conditions or the length of transport. Among these are flowers, plants, food (meat, smoked meats, fish, fruits and vegetables, milk products)

2. UK Proxy Address
An Post will provide the Customer with a UK proxy address. On receipt of an Item addressed to the Customer at the UK proxy address, An Post will forward it to the Collection Point.

3. Collection Conditions
When an Item addressed to the Customer is received at the Collection Point, An Post will notify the Customer. The Item will be held at the Collection Point for 5 working days. Thereafter it will be disposed of by being returned to sender or otherwise dealt with as determined by An Post at its discretion. The Item may be collected by the Customer from the Collection Point by producing evidence of identity acceptable to An Post and by paying the appropriate fee as specified in the AddressPal Fee Schedule.

4. Dimensions

Every Item shall comply as to size and weight with the following limits – 72cm x 31cm x 25cm and weighing less than 20kgs.
(a) If an Item which exceeds the weight and size limits for the time being prescribed, but within An Post’s standard size and weight dimensions for parcels, the fee shall be €25.00. Such Item may also be subject to collection from a place designated by An Post which may not be the Collection Point.
(b) Oversized Items or items exceeding 20kg weight or which bear an incorrect address shall be returned to sender.
5. Packaging

Every Item shall be adequately packed as a protection against damage in course of transmission. An Post reserves the right to refuse any Item it deems to be inadequately packed or likely to cause damage to other Items, to staff or to equipment.

(a) If detected in transit dangerous, hazardous or prohibited Items may be refused or detained and disposed of. A list of such items is contained in condition 9. The Customer will be liable for all costs incurred in disposal and for all loss arising from damage to other items or to staff or equipment or for loss arising from delays or disruption to service. An Post shall not be under any obligation to return the Item to the sender or to deliver it and shall incur no liability whatsoever irrespective of any other conditions of the service.

6. Liabilities Not Assumed

(a) An Post is not a common carrier and will accept Items for carriage only on the condition that it is not a common carrier.

(b) An Post will not be liable for any direct, indirect or consequential loss or damage arising from or caused by:
    (i) failure to perform any of its obligations if such failure is the result of circumstances outside its control including the outbreak of war, Government Act, explosion, accident, civil commotion, riot, industrial dispute, strike, lock-out, stoppage or restraint of labour from whatever cause, whether partial or general, weather conditions, traffic congestion, mechanical breakdown, obstruction of any public or private road or highway or any other Act of God;
    (ii) insufficient or improper packing or addressing;
    (iii) Items of a prohibited nature;
    (iv) failure by the Customer to take delivery from the Collection Point within 5 working days;
    (v) delay or seizure of any Item by any Customs Authority because of incorrect, insufficient, incomplete or improper documentation. The Customer is responsible for ensuring that the correct and complete documentation required by the Customs Authority is securely attached to the outside of the item at the time of posting and acknowledges that An Post is not responsible for the presentation of this documentation to Customs and also indemnifies An Post for any fines, costs or losses incurred due to submission of unacceptable documentation.

7. Limitation of Liability - Direct Losses

Without prejudice to conditions 6, 8 and 9 the liability of An Post for any physical loss or damage to the Item is limited to the lesser of: 
    (i) the amount of loss or damage actually sustained.
    (ii) €40. An Post is not in any event liable in excess of these amounts.

8. Limitation of Liability - Indirect Losses Excluded

An Post shall not be liable, in any event, for any consequential or indirect loss or damage, including without limitation, loss of income, profits, interest, utility or loss of market, including without limitation damage arising from loss, damage or delay to any Item, however arising in respect of any of its services.

9. Materials Not Accepted
An Post does not carry: Dangerous, poisonous or infectious items, explosives, munitions of war, firearms, corrosives, acids, paint removers, oxidising substances, organic peroxides, compressed, liquidised or dissolved gases (especially butane gas lighters or aerosols), flammable solids or liquids or materials liable to spontaneous combustion, paints, varnishes, dyes, radioactive materials (except under licence), pornography or anything that would cause embarrassment in transit, living creatures, prescribed or dangerous drugs (except under statutory licence), mercury, materials deemed illegal or prohibited by any Government Authority, Perishable Goods, organic or biological materials likely to perish under normal transit conditions IATA restricted articles - such as liquids, Items likely to cause injury to any other Item or person, any other Items that from time to time may have to be added to the foregoing list are prohibited, unless An Post has agreed in writing to carry such Items subject to such conditions as determined by An Post.

10. Claims
    (a) Any claim must be brought by the Customer and submitted in writing to the Customer Services Section, An Post, GPO, Lower O’Connell St, Dublin 1 D01 F5P2 within 30 days of the notification of availability for collection from the Collection Point. Such claims must be accompanied by:
         (i) Statement of the amount claimed (in Euro).
         (ii) Copy of Original Purchase Invoice of contents to provide evidence of cost price.
         (iii) Detailed description of goods involved.
         (iv) In the event of non-delivery/damage etc. copy of a written statement from the consignor confirming despatch.

If claiming for damaged goods, the address (and telephone number of contact) of where the goods are available for inspection should be supplied together with an estimate of the cost of repair. N.B. All damaged goods and packing must be retained for inspection. Failure to do so may adversely affect claims.
11. Claims - Time Limit
Claims not brought within the terms of condition 10 are excluded and no liability shall be accepted under any circumstances in respect of such claims.

12. Lien on Items Posted
An Post shall have a lien on any Items posted for all charges, Customs duties, VAT or other charges of any kind arising out of transportation hereunder and is entitled to dispose of such items in any manner should the charges requested remain unpaid [60] days after notification of availability for collection from the Collection Point.

13. Data Protection
    13.1 - The AddressPal Page forms part of the An Post website. The Customers use of the AddressPal Page is governed by the An Post Policies located at Such policies include without limitation, An Post’s Web Policy, Data Privacy Statement, and information about An Post’s use of cookies on its website.
    13.2 - By agreeing to these Terms, the Customer is deemed to have read and agreed to be bound by the An Post Policies, each of which forms an integral part of these Terms and is incorporated into these Terms by this reference.
    13.3 - The Customer acknowledges that by using the AddressPal Service that the Customer is providing information which is confidential to the Customer and the Customer accepts that this will be used only for the provision of the Service and will not be divulged to any third party for any reason other than to ensure the normal operation of the service, where required by law and/or where required and/or necessary for the purpose of giving effect to anti-money laundering and anti-fraud and fraud detection procedures.
    13.4 - Personal data provided by the Customer when using the Service, may be used by An Post for the purposes of giving effect to instructions, keeping the database up to date and accurate as required by law, verification of identification details to be used for the Service, contacting the Customer with regard to the Service, alerting the Customer to changes in the Service or changes which may affect the Service. More information on Data Protection is contained in the An Post Web Policy. 
    13.5 - An Post may also wish to use the Customers personal data to provide the Customer with information regarding the Service and Service enhancements (for example changes to the service, service enhancements, promotions in connection only with the use of the Service).

14. Changes to terms and conditions
An Post reserves the right to change these terms and conditions and the fees for AddressPal Service on 30 days’ notice to the Customer.

15. Suspension of Service
An Post reserves the right to restrict or discontinue the Service at its absolute discretion.

16. Governing Law
These terms and conditions and the respective rights and obligations of the parties hereto, shall be governed by and construed in accordance with the laws of the Republic of Ireland.
