By tendering items for shipment by any An Post Parcel Service the Customer agrees to these terms and conditions.
By the conditions set out below, An Post and its servants and agents are firstly not to be liable at all for certain losses and damage, and secondly, wherever they are to be liable, the amount of liability is strictly limited as stated in conditions 7 and 8.
Customers are therefore advised to purchase insurance cover to ensure that their interests are fully protected in all events.
In these conditions the following expressions shall have the meaning hereby respectively assigned to them i.e.
(a) "Parcel Service" means the services provided by An Post under the names COURIERPOST, EXPRESSPOST, REGISTEREDPOST and STANDARDPOST (PARCELPOST) and such other services as An Post shall from time to time decide.
(b) "Item/Shipment" shall mean any package, letter, parcel and the contents thereof.
(c) "Customer" shall mean the individual or company who has contracted An Post to deliver their shipments.
(d) "COURIERPOST" shall mean the Express Mail Service. All of these conditions shall apply to COURIERPOST, in addition to any other conditions applicable to that service, (please add one day to delivery times for items posted outside of Dublin)
(e) "Money" shall mean:
(i) any current bank note, currency note or coin
(ii) any uncrossed postal money order which does not state to whom it is to be paid
(iii) any cheque or dividend warrant
(iv) any bearer security (including a share warrant, scrip or subscription certificate, bond or relative coupon)
(v) any uncancelled postage or revenue stamp valid for current use (except a revenue stamp embossed or impressed on an instrument which has been executed)
(vi) any coupon, voucher, token, card, stamp, or similar document which can be exchanged (by itself or with any other document) for money, goods or services
(vii) Bank drafts.
(f) "Jewellery" shall mean gold, silver, platinum, diamonds, precious metals, carbons or stones (whether in a manufactured or raw state) or watches.
(g) "Works of Art" shall mean paintings, pictures, sculptures and other fine arts.
(h) "Collectables" and "Antiques" shall mean items which have appreciated in value either due to their scarcity or due to their being out of production.
(i) "Glass" shall mean any item made from glass such as mirrors, ornaments, trophies, crystal, picture frame glass and any other glass parts or items.
(j) "Perishable Goods" shall mean types of goods whose qualities may worsen or which tend to spoil easily under the influence of changes in climate, temperature, elevation or even general environmental conditions or the length of transport. Among these are flowers, plants, food (meat, smoked meats, fish, fruits and vegetables, milk products).
(k) "the Guide" shall mean the current edition of ‘The Guide to An Post Postal Services’.
2. Posting Documentation
(a) Account Customers shall provide with each posting a completed posting list containing details including name and address of consignee, weight of item and charges of each item being dispatched. This list should be handed over to the An Post official accepting the items.
(b) An administrative charge of €6.00 shall be levied on the Customer for each and every posting list which the Customer fails to complete in the manner described at (a) above.
3. Collection Conditions
(a) A collection service from the Customer’s premises may be provided at the total discretion of An Post.
(b) If a collection service is provided by An Post, the Customer agrees to present all items in appropriate packaging unless otherwise agreed in writing with An Post.
(c) An administrative charge of €6.00 shall be levied on any Customer who includes among items tendered for shipment via any An Post Parcel Service, an item or items which, on inspection by An Post officials, is/are found to be deficient in postage or under declared in charges payable. This charge will be levied in addition to the actual postage deficiency.
(a) Every item shall comply as to size and weight with the limits for the time being prescribed as detailed in the Guide to Postal Services.
(b) Where a Customer includes among items tendered for shipment by any An Post Parcel Service, an item or items which exceed the weight and size limits for the time being prescribed (see condition 4a), the maximum rate of postage for delivering plus €50.00 per item, plus an additional fee of €5.00 per kilo or part there of, shall be levied on the Customer. Such items may also be subject to delayed delivery.
Every item shall be adequately packed as a protection against damage in course of transmission and in particular:
(a) Every item shall have a return address or indication of origin acceptable to An Post, clearly displayed on the outside of the packaging.
(b) An item which is of a fragile nature shall be packed in a container of sufficient strength and shall be surrounded in that container with sufficient and suitable material against the effect of such concussion, pressure and knocks to which items are ordinarily exposed in transmission, and the item shall bear the words "FRAGILE WITH CARE" written conspicuously in capital letters on the face of the cover above the address.
(c) Any item which is heavy to handle, weighing 5 kg or over, shall have the weight shown and a heavy item label affixed. Supplies of heavy item labels are available from An Post on request.
(d) An item which is liable to be damaged by bending shall be packed in a container of sufficient strength to prevent the item from being bent in transmission, and the item shall bear the words "DO NOT BEND" written conspicuously in capital letters on the face of the cover.
(e) Dangerous, hazardous or prohibited items will be refused if tendered for transmission, or if detected in transit will be detained or treated in accordance with the various statutory regulations and/or Postal Warrants in force at the time. A list of such items is contained in condition 11. The sender of such an item will be liable for all costs incurred in its disposal and for all loss arising from damage to other items or to staff or equipment or for loss arising from delays or disruption to service. An Post shall not be under any obligation to return the item to the sender or to deliver it and shall incur no liability whatsoever irrespective of any other conditions of the service.
6. Liabilities Not Assumed
(a) An Post is not a common carrier and will accept items for carriage only on the condition that it is not a common carrier.
(b) An Post will not be liable for any direct, indirect or consequential loss or damage arising from or caused by:
(i) failure to perform any of its obligations if such failure is the result of circumstances outside its control including the outbreak of war, Government Act, explosion, accident, civil commotion, riot, industrial dispute, strike, lock-out, stoppage or restraint of labour from whatever cause, whether partial or general, weather conditions, traffic congestion, mechanical breakdown, obstruction of any public or private road or highway or any other Act of God;
(ii) insufficient or improper packing or addressing (please consult the packing recommendations shown in the Guide);
(iii) items of a prohibited nature - see condition 11;
(iv) failure by the addressee to take delivery within a reasonable time;
(v) delay or seizure of any item by any Customs Authority because of incorrect, insufficient, incomplete or improper documentation. The Customer is responsible for ensuring that the correct and complete documentation required by the Customs Authority is securely attached to the outside of the item at the time of posting and acknowledges that An Post is not responsible for the presentation of this documentation to Customs and also indemnifies An Post for any fines, costs or losses incurred due to submission of unacceptable documentation.
(c) Items are accepted by An Post or its agents subject to the condition that the service purchased can be provided according to specifications in the appropriate service guide at the time of posting. The Customer will be liable for all costs (other than those arising from the negligence of An Post) involved in recovery, redelivery, return or loss of items posted where it is subsequently discovered that (i) service is not available to that destination; (ii) service is unavailable for any other reason whatsoever.
7. Limitation of Liability - Direct Losses
Without prejudice to conditions 6, 9, 10, 12 & 13 the liability of An Post for any physical loss or damage to the item is limited to the lesser of:
(i) the amount of loss or damage actually sustained
An Post is not in any event liable in excess of these amounts and the Customer should insure accordingly.
8. Limitation of Liability - Indirect Losses Excluded
An Post shall not be liable, in any event, for any consequential or indirect loss or damage, including without limitation, loss of income, profits, interest, utility or loss of market, however arising in respect of any of its services, and the Customer should insure accordingly.
(a) An Post will until further notice provide inclusive insurance cover subject to a maximum of €350 for COURIERPOST items (nationally and internationally) and a maximum cover of €320 for REGISTEREDPOST items (nationally only. Rates differ internationally, please consult the Guide to Postal Services), and a maximum cover of €350 for EXPRESSPOST (service only available in the Republic of Ireland), in respect of physical loss or damage in respect of what is contained in an item subject to the following:
(i) the availability of service at the time of posting
(ii) that insurance is available for the destination at the time of posting
(iii) that the contents are not excluded for insurance (as per condition 9(d) and 9(e)) and/or not declared prohibited, according to condition 11 herein.
(b) Consequential loss or indirect loss of any kind resulting from delay or loss of the item or its contents is not covered by any insurance and the Customer should insure accordingly.
(c) An Post will not provide inclusive insurance for the STANDARDPOST (PARCELPOST) service.
(d) In addition to the above, items containing money, jewellery, ceramics, glass, works of art, antiques or collectables (see definitions) are not insured under any An Post Service.
(e) Documents are not insured under any An Post service.
10. Optional Insurance
(a) At the request of the Customer and upon payment of the fee applicable at the time, An Post will arrange optional insurance on behalf of the Customer in an amount not exceeding €2000 for REGISTERDPOST items subject to the following:
(i) the availability of service at the time of posting
(ii) that the item destination is within Ireland
(iii) that the contents are not excluded for insurance (as per
condition 9(d) and 9(e)) and/or not declared prohibited, according to condition 11 herein.
(b) Consequential loss or indirect loss of any kind resulting from delay or loss of the item or its contents are not covered by insurance and the Customer should insure accordingly.
11. Materials Not Accepted
(a) An Post has certain standard restrictions and prohibitions on items it will carry and it is important that the Customer consult the list below prior to posting.
Standard List of Prohibitions for all Services;
Dangerous, poisonous or infectious items, explosives, munitions of war, firearms, corrosives, acids, paint removers, oxidising substances, organic peroxides, compressed, liquidised or dissolved gases (especially butane gas lighters or aerosols), flammable solids or liquids or materials liable to spontaneous combustion, paints, varnishes, dyes, radioactive materials (except under licence), pornography or anything that would cause embarrassment in transit, living creatures, prescribed or dangerous drugs (except under statutory licence), mercury, materials deemed illegal or prohibited by any Government Authority, perishable goods, organic or biological materials likely to perish under normal transit conditions IATA restricted articles - such as liquids (see International Section of the Guide), items likely to cause injury to any other item or person, any other items that from time to time may have to be added to the foregoing list are prohibited, unless An Post has agreed in writing to carry such items subject to such conditions as determined by An Post.
(a) Any claim must be brought by the Customer and submitted on an official An Post claim form (available at your local Post Office) to the Customer Services Section, An Post, GPO, O’Connell St, Dublin 1 within 30 days of the date of posting. Such claims must be accompanied by:
(i) Statement of the amount claimed (in Euro).
(ii) Copy of An Post receipt of posting.
(iii) Copy of Original Purchase Invoice of contents to provide evidence of cost price.
(iv) Detailed description of goods involved.
(v) In the event of non-delivery/delay/damage etc. copy of a written statement from the consignee confirming loss or damage.
If claiming for damaged goods, the address (and telephone number of contact) of where the goods are available for inspection should be supplied together with an estimate of the cost of repair.
N.B. All damaged goods and packing must be retained for inspection. Failure to do so may adversely affect claims.
(b) The amount of any such claim may not be deducted from any charges owed.
13. Claims - Time Limit
Claims not brought within the terms of condition 12 are excluded and no liability shall be accepted under any circumstances in respect of such claims.
14. Lien on Items Posted
An Post shall have a lien on any items posted for all charges, Customs duties, VAT or other charges of any kind arising out of transportation hereunder and is entitled to dispose of such items in any manner should the charges requested remain unpaid after 60 days after posting.
(a) An Post shall, in any case where payment of charges has not been made in advance of posting, render to the sender an invoice showing the charges due in respect of the services provided during the said period and the sender shall pay to An Post the full amount shown on the said invoice within 30 days of the date thereof.
(b) A claim or counter claim made under any part of this service shall not be made the reason for deferring or withholding payment of monies payable or liabilities incurred to An Post.
(c) All amounts outstanding greater than 30 days from the date of invoice shall be subject to an interest charge of 1.5% per month for each month for which the amount remains unpaid.
16. Proof of Delivery
Where proof of delivery (POD) forms part of the service, the facility is available on the An Post web site for one month from the date of despatch and for six months by application to the An Post Customer Service Department. No proof of delivery is retained in excess of six months from date of despatch.
